Booking Conditions

1. IDENTIFICATION OF THE WEBSITE OWNER

2. PURPOSE AND SCOPE

These General Terms and Conditions govern the contractual relationship between Goetten Apartamentos S.L. (hereinafter, “the Establishment”) and the customer who books accommodation through the goetten.es website or through any other channel made available by the Establishment.

Making a booking implies full and unconditional acceptance of these terms and conditions in the version published at the time the contract is entered into.

3. DESCRIPTION OF THE SERVICE

The Establishment offers tourist accommodation services in apartments located in Platja d'Aro (Girona), under a holiday rental arrangement for specified periods. The apartments are registered in the Catalonia Tourism Register under number ATG-000091-ATG, in accordance with Decree 75/2020 of 4 August on tourism in Catalonia.

4. BOOKING PROCESS

4.1. Booking request
Customers may make a booking through the booking engine available on the goetten.es website. Once the booking form has been completed, the customer will receive a confirmation email containing a summary of the booking.

4.2. Confirmation and deposit
The booking will be confirmed once the customer pays a deposit equivalent to 20% of the total cost of the stay by bank transfer, within the period indicated in the confirmation email. Until this payment has been received, the Establishment does not guarantee the availability of the apartment.

4.3. Payment of the remaining amount
The remaining amount (80%) must be paid in accordance with the conditions indicated in the confirmation email or, at the latest, at check-in.

4.4. Payment methods
The Establishment does not have an online payment gateway. Payments are made exclusively by bank transfer to the account indicated in the confirmation email. Credit or debit card details are neither stored nor requested through the website.

5. PRICES AND TOURIST TAX

5.1. Prices
The prices shown on the website include accommodation for the selected number of guests and nights. Any additional service not included in the basic rate will be communicated to the customer before confirmation.

5.2. Tourist tax
In accordance with Catalan Law 5/2017 of 28 March on tax, administrative, financial and public-sector measures, a tourist tax of €0.99 per person per night applies to guests over 16 years of age, for a maximum of 7 nights per stay. This amount must be paid by the customer at check-in.

6. CANCELLATION AND AMENDMENT POLICY

6.1. Free cancellation
Customers may cancel their booking free of charge up to 7 calendar days before the scheduled arrival date.

6.2. Late cancellation and no-show
In the event of cancellation less than 7 calendar days before the arrival date, or in the event of a no-show, 100% of the total cost of the stay will be charged.

6.3. Changes of dates
Any change to the dates of the stay will be treated as a cancellation of the original booking and a new booking, subject to availability and to the cancellation policy in force at the time of the change.

6.4. Right of withdrawal
In accordance with Article 103.l) of Spanish Royal Legislative Decree 1/2007 of 16 November, approving the consolidated text of the General Law for the Protection of Consumers and Users, the right of withdrawal does not apply to contracts for the provision of accommodation services for purposes other than residential purposes where the contracts provide for a specific date or period of performance. The customer is expressly informed of this exclusion at the time the contract is entered into.

7. CHECK-IN AND CHECK-OUT

7.1. Times

  • Check-in: from 4:00 p.m.
  • Check-out: before 10:00 a.m.

Any variation to these times must be agreed in advance with the Establishment and will be subject to availability.

7.2. Guest identification
In compliance with Spanish Royal Decree 933/2021 of 26 October, all guests over 14 years of age must present a valid identity document (DNI, NIE or Passport) at check-in. The Establishment is required to report this information to the Spanish State Security Forces and Corps within a maximum period of 24 hours from check-in.

7.3. Security deposit
The Establishment does not require a security deposit at check-in.

8. RULES FOR USING THE ACCOMMODATION

The customer undertakes to make appropriate use of the apartment and its facilities, respecting the rules of coexistence and the applicable regulations. Failure to comply with these rules may result in the immediate termination of the contract without the right to a refund.

The maximum number of occupants of the apartment is indicated in the description of each unit. The presence of persons who were not registered at check-in is not permitted.

9. LIABILITY

The Establishment shall not be liable for any damage or loss resulting from the customer's improper use of the facilities, or for personal belongings left in the apartment. The customer shall be liable for any damage caused to the apartment or its facilities during the stay.

10. DATA PROTECTION

The personal data provided by the customer during the booking process will be processed by Goetten Apartamentos S.L. as data controller, in accordance with the Privacy Policy available at goetten.es/politica-de-privacidad and with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 (LOPDGDD).

11. APPLICABLE LAW AND JURISDICTION

These General Terms and Conditions are governed by Spanish law. For the resolution of any dispute, the parties submit to the courts and tribunals of the consumer's place of residence, without prejudice to any other jurisdiction that may apply under consumer and user protection regulations.

12. AMENDMENT OF THE TERMS AND CONDITIONS

The Establishment reserves the right to amend these General Terms and Conditions at any time. Amendments will be published on the website and will apply to bookings made after their publication.
